By downloading, installing, or using WhisperDesk (“the Software”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to:

  • Download and install the Software on devices you own or control
  • Use the Software for personal or commercial purposes

Free Trial

The free trial allows limited use of the Software (10 transcriptions) to evaluate its features. The trial version is provided “as is” without any guarantees.

Pro Licence

A Pro licence grants you access to all features for the duration of your subscription period. The licence is valid for use on up to 3 devices owned by you.

3. Subscription and Payment

Pro licences are sold as annual subscriptions. Payment is processed securely through Stripe.

  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • We offer a 30-day money-back guarantee for first-time purchases

4. Refund Policy

We offer a 30-day money-back guarantee for first-time purchases. If you're not satisfied with WhisperDesk, contact us within 30 days of purchase for a full refund.

Refunds for renewal payments are handled on a case-by-case basis. Contact support if you believe you were charged in error.

5. Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify or create derivative works based on the Software
  • Distribute, sell, lease, or transfer the Software or your licence
  • Remove any proprietary notices or labels
  • Use the Software to violate any applicable laws

6. Intellectual Property

The Software and all related materials are protected by copyright and other intellectual property laws. We retain all rights not expressly granted in these Terms.

Your transcription outputs are your property. We claim no rights to content you create using the Software.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free or uninterrupted, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Software shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

10. Updates

We may release updates to the Software from time to time. Updates may be required for continued use of certain features. We are not obligated to provide updates or support for older versions.

11. Termination

We may terminate your licence if you violate these Terms. Upon termination, you must cease all use of the Software and destroy any copies in your possession.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Software after changes constitutes acceptance of the modified Terms.
